    Crime, Donald Trump, Mueller, Russia

Donald Trump’s legal team is desperately grasping at straws in an effort to save him from Special Counsel Robert Mueller, but unfortunately for him, they’re just as incompetent as the president.

Over the weekend, a letter that Trump’s legal team members John Dowd and Jay Sekulow sent to Mueller in January was released — and it has revealed glaring mistakes. The letter was drafted in order to protect Trump from a subpoena Mueller might throw his way — but instead, it just made things worse. Trump’s legal team screwed up on this letter big time and now the president is f*cked.

One of the biggest mistakes in the letter is the fact that the lawyers mentioned the wrong obstruction statute. The letter states:

“… § 1505 of Title 18, United States Code…forbids anyone from corruptly, or by threats of force or by any threatening communication, influencing, obstructing, or impeding any pending proceeding before a department or agency of the United States, or Congress…No court has ever held than an FBI investigation constitutes a § 1505 proceeding… As a matter of law, then, the FBI’s investigation of Lt. Gen. Flynn was not, at the time of the President’s comments as recalled by Mr. Comey, within the scope of § 1505.”

First of all, an FBI investigation doesn’t count as a “pending proceeding.” But more importantly, Trump would be prosecuted under obstruction of justice 18 USC §1512 — not 18 USC §1505, as the statute criminalizes corrupt meddling with investigations prior to proceedings. Despite the fact that this statute fits Trump’s situation best, there is no mention of 18 USC § 1512 in the entire 20-page dissertation, which is absolutely ridiculous. Every single legal expert who has spoken about this has focused on this statute — for Trump’s lawyers to completely ignore it will not go unnoticed by Mueller and he probably laughed his a** off about it.

That’s not all. The document also contained other ridiculous statements, most of which had the common theme of Trump being 100 percent innocent. In one part of the letter, Trump’s lawyers actually tried to argue that Trump was above the law just because of his job title:

“[T]he President’s actions here, by virtue of his position as the chief law enforcement officer, could neither constitutionally nor legally constitute obstruction because that would amount to him obstructing himself…”

Trump and his team have acted like The Donald is above the law from the beginning, and they’re in for a very rude awakening. This letter, with the sloppy way it was thrown together, isn’t going to do a damn thing to protect the president. If anything, it shows how easy it will be to bring Trump down.
